Furtrieve Community Pet Services and Product Purchase Agreement

This Pet Services and Product Purchase Agreement (“Agreement”) is a binding agreement between you, the purchaser and user of pet-related services and/or products (“User” or “you”), and Furtrieve, LLC, an Indiana limited liability company (“Furtrieve, LLC,” “we,” or “us”). By accessing or using the Furtrieve Community mobile application or website (the “Platform”) to purchase or book services or products, you acknowledge and agree to be legally bound by this Agreement.

1. Nature of the Platform and Transactions

Furtrieve, LLC and Furtrieve, LLC Community operate a Platform that allows Users to discover, connect with, and pay for services and products offered by independent third-party pet service providers and vendors (collectively, “Providers”).

Services and products that may be available through the Platform include:

• Dog and Cat Walking
• Pet Sitting and Pet Boarding
• Animal Physical Therapy
• Pet Acupuncture and Chiropractic Services
• Pet Grooming and Waste Removal
• Pet Photography Services
• Pet Training
• Pet Food and Treats
• Pet Specialty Products (including harnesses, toys, apparel, gifts, costumes, and accessories)
• Other various pet services that may arise from user needs.

Furtrieve, LLC does not own, operate, supervise, or manage any of the Providers or their services and products, and does not guarantee their availability, quality, accuracy, legality, or safety.  Furtrieve Community does not allow nor condone selling of animals on our platform.  Any user attempting to sell an animal will be removed and banned.

2. Independent Relationship

You acknowledge and agree that:

• Providers are independent contractors and not agents, employees, or affiliates of Furtrieve, LLC;
• Furtrieve, LLC does not vet or endorse any Provider beyond what is displayed on the Platform;
• Furtrieve, LLC is not a party to, and does not oversee or enforce, any agreement you enter into with a Provider.

All transactions, disputes, or service issues are solely between you and the Provider.

3. Payment Terms and Processing Fee

By purchasing or booking a service or product through the Platform, you agree to the following:

• You are authorizing Furtrieve, LLC (or its third-party payment processor) to collect and process payment on your behalf for services/products you order.
• A 5% non-refundable processing fee will be added to each transaction total and charged to you, the User.
• This 5% fee is paid directly to Furtrieve, LLC for use of the Platform and does not go to the Provider. This fee is used for bank processing fees and operational funding.
• Prices, availability, and scheduling are determined by each Provider and are subject to change.

4. User Responsibility and Acknowledgment of Risk

You acknowledge and agree that:

• It is your responsibility to review Provider qualifications, experience, and policies;
• Engaging pet-related services involves inherent risks, including injury to you, your pet, property damage, illness, or behavioral consequences;
• You assume full responsibility for such risks and release Furtrieve, LLC from any liability in connection with them;
• You are solely responsible for any instructions, disclosures, or arrangements made with a Provider.

5. Indemnification and Limitation of Liability

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Furtrieve, LLC and its officers, employees, agents, affiliates, and licensors from all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

• Any act or omission by a Provider;
• Any personal injury, death, property damage, or animal injury resulting from services or products purchased through the Platform;
• Your violation of this Agreement or applicable laws;
• Any disputes, fraud, or misconduct related to Providers you engage through the Platform.

FURTRIEVE, LLC SHALL NOT BE LIABLE for any indirect, incidental, punitive, or consequential damages, including lost profits, arising from use of the Platform or Provider services.

6. No Refunds by Furtrieve, LLC

All refund or cancellation requests must be directed to the individual Provider in accordance with their policies. Furtrieve, LLC does not issue refunds for services or products provided by third parties.

The 5% processing fee charged to Users by Furtrieve, LLC is non-refundable under all circumstances except for Fundraisers that are cancelled for valid reasons or services that are cancelled within a 24 hour .time period prior to commencement of services.

7. Dispute Resolution

Furtrieve, LLC is not responsible for mediating disputes between Users and Providers. However, you may report Provider misconduct or safety concerns to support@Furtrievecommunity.com for investigation and potential Platform removal.

8. Governing Law and Venue

This Agreement shall be governed by the laws of the State of Indiana, without regard to conflict of law principles. Any legal proceeding arising from this Agreement shall be brought in a court of competent jurisdiction located in Indiana.

9. Amendments

Furtrieve, LLC reserves the right to amend this Agreement at any time by posting an updated version on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the updated Agreement.

10. Entire Agreement

This Agreement, together with our Terms of Use and Privacy Policy, constitutes the entire understanding between you and Furtrieve, LLC regarding your use of the Platform for purchasing services or products.

11. Acknowledgment

By proceeding with a transaction through the Furtrieve, LLC Community app, you:

• Confirm that you have read, understood, and agreed to all terms in this Agreement;
• Release Furtrieve, LLC from all claims related to Provider services or products;
• Accept the 5% User processing fee as part of each transaction total.
